An attorney representing Deathrow Records CEO Marion 'Suge' Knight plans to file a motion in Los Angeles County Superior Court today (January 2) claiming that a woman and her imprisoned husband committed fraud to win a $130 million judgment against Knight.

In 2005, a judge ordered Knight to pay $130 million to Lydia Harris who claimed that she  helped the rap mogul start the label but was forced out after she pointed out she was owed profits.

According to The Los Angeles Times, Knight's lawyer, Dermot Givens, claims he has new evidence showing  that Lydia's lawsuit  was the brainchild of her incarcerated husband, Michael 'Harry-O' Harris ,  a reputed drug dealer who claimed that he gave Knight money to launch Deathrow.

Michael Harris has repeatedly asserted that he financed Deathrow Records from prison where he is serving a 28-year sentence for selling crack cocaine and attempted murder. 

In 1996, Michael Harris notified Deathrow and its distributor, Interscope Records, that he planned to sue them but he would eventually sign a $300,000, out-of-court settlement re leasing both companies from any future claims.  Lydia would then sue Knight in 2002.

Knight's lawyer, Givens, claims that he has recent sworn testimony by Lydia and Michael Harris during their divorce proceedings which prove that Michael was the real party of interest in Lydia's suit against Knight.  The Harris’ filed for divorce soon after the judgment against Knight.

“I was the one making all major client decisions on behalf of the marital estate, even though Lydia was technically named the plaintiff in the matter,” Michael Harris said in a recent declaration.  “Lydia simply accepted whatever decision [her lawyer] and I made jointly.”

Givens motion will also show that Lydia had filed for bankruptcy five years before suing Knight and that she never notified the trustee of her bankrupt estate that she had an ownership stake in Deathrow or that she had filed a lawsuit against Knight.

The Harris’ could not be reached for comment and their attorneys did not return phone calls.
