The man police said beat to death the father of Nappy Roots rapper KD agreed to a plea deal today (October 20).
Earlier this year, Frankie Lee Roberson was indicted for killing McOwen Drane, KD's father.
The prosecution said Roberson beat Drane's head against a brick wall outside a liquor store in March.
Drane, 64, who was diagnosed with liver cancer before his death, made it back to his house on 24th Street, in Louisville, before collapsing. He later died at the hospital.
Roberson pleaded not guilty to a murder charge for killing Drane. Prosecutor Krisi Gray offered that he plead guilty, instead, to reckless homicide.
Gray said the decision was based on circumstances and evidence.
Drane's ex-girlfriend, who found him unconscious, said it's a miscarriage of justice.
“He should be getting more time. It's that simple,” said Victoria Duncan. “It’s just devastating.”
“We had to consider not only his intent, but his conduct and whether or not we could prove wanton versus reckless conduct,” said Gray.
“Actually, I want to commend the commonwealth. I think it was a very fair plea agreement,” said Roberson’s defense
attorney, Ray Stoess.
With the plea deal came a recommended five year sentence with no chance of parole or shock probation. The judge will announce a decision on whether to accept the recommendation on Dec. 9.
