So So Def honcho Jermaine Dupri has filed a lawsuit against a nightclub and a promoter for the unauthorized use of his name in Atlanta.
According to the papers filed on Tuesday, nightclub Pure Atlanta and Binyam Yayin from the Entertainment Group, LLC had used the rapper's name to promote their "All Black Affair" in November.
Two days prior to November 20 affair, Dupri's manager Nick Leo had received a request from the promoter asking that the rapper make an appearance at the club on that particular night. Leo declined on behalf of his client, explaining that the rapper will be out of the country.
Despite declining, the nightclub still proceeded to promote the event. It was advertised through flyers, online postings, and radio ads using Dupri's name and images.
Leo contacted the defendants immediately after learning of the nightclub's promotional methods and asked them to cease using Dupri's name in connection with the affair.
Dupri accuses the nightclub and the promoter of violating his right of publicity, unfair competition, false advertising and unfair and deceptive trade practices. He is seeking permanent injunction preventing the misuse of his name, image and likeness by the promotional agency's agents.
